Cop in fatal cyclist crash feels heat

SANTA CLARA, CA The CHP suggests misdemeanor vehicular manslaughter charges be filed, according to the San Jose Mercury News.

If convicted on those charges, Deputy James Council would face up to two years in jail and could be charged with a felony.

Sources say the CHP does not believe the deputy is guilty of gross negligence, meaning he wasn't drunk behind the wheel.

Again, these are just recommendations. The Santa Clara County District Attorney will make the final decision on which charges to file.
