Chu said he also charged the suspect, 27-year-old Juan Magana, with a misdemeanor charge of being an unlicensed driver and a misdemeanor charge of filing a false police report.
Chu said that after Magana fled the scene of the accident, which happened in the 1300 block of 100th Avenue about 2:30 p.m. Saturday, he contacted the previous owner of the van to ask him to call police and report that the van had been stolen.
The prosecutor said the sale of the van from the previous owner to Magana apparently had not been completed, so he believes that Magana was trying to hide his identity.
The boy killed in the accident was identified as Luis Hernandez, Jr.
Magana turned himself in on Sunday.
He is scheduled to be arraigned at the Wiley Manuel Courthouse in Oakland this afternoon.
