San Jose police have arrested a 36-year-old parolee found hiding in an attic Tuesday night after an alleged burglary attempt, Office Jermaine Thomas said.

A couple returning home around 10:30 p.m. from an evening out with friends noticed lights on in their house in the 100 block of Rosemary Street, Thomas said.

They called police, who surrounded the home. The suspect, identified as San Jose resident James Nickell, was found hiding in a neighbor's attic.

Nickell has prior burglary offenses on his record and had an active warrant out for his arrest due to another parole violation, Thomas said.

Nickell was arrested and booked into Santa Clara County Jail. He is being held on no bail status because of his alleged parole violation.
