Healthy San Francisco makes health care available to all uninsured city residents by requiring employers with more than 20 workers to pay into the fund.
But the Golden Gate Restaurant Association challenged it, arguing that under federal law, health care requirements cannot be locally imposed.
The Obama administration says however, that provisions in the new health care reform package make the challenge a moot point.
