Lawyers for Albert Greenwood Brown filed court papers Sunday appealing a federal judge's refusal to block that execution. Brown is also refusing to choose between lethal injection by a single drug or a three drug cocktail.
If the appeals court does not block California's first execution in nearly five years, the drug cocktail will be used.
Brown was convicted of raping and murdering 15-year-old Susan Jordan of Riverside County 30 years ago.
