According to the San Jose Mercury News, the suit accuses the manager of disciplining Latino employees more harshly and more frequently than their Asian counterparts. It claims the restaurant made Latino workers clean toilets and perform other work while Asian employees stood around and watched.
The suit filed by the Equal Employment Opportunity Commission accuses Panda Express of violating the Civil Rights Act - which prohibits discrimination based on ethnicity.
A Panda Express spokesman says the company doesn't comment on pending litigation.
