Wilfredo "Flaco" Reyes, 31, was arrested in Rowan County, N.C., on July 9 for allegedly fatally shooting Anthony Bologna, 48, and his sons Michael, 20, and Matthew, 16, at the intersection of Maynard and Congdon streets in San Francisco's Excelsior District on June 22, 2008.
Reyes is expected to make his initial appearance in court at the San Francisco Hall of Justice at 1:30 p.m. today, district attorney's office spokesman Alex Bastian said.
He returned to San Francisco shortly after 9:30 p.m. after being extradited from Rowan County, N.C., San Francisco sheriff's spokeswoman Susan Fahey said.
Investigators believe Reyes and Edwin Ramos, 25, both alleged members of the MS-13 criminal gang, killed the Bolognas after mistaking them for rival gang members.
Ramos was convicted this May of three counts of first-degree murder for the killings and was sentenced to three consecutive terms of life in prison.
He denied shooting the Bolognas, testifying during the trial that he was driving his car when Reyes suddenly opened fire on the family from the passenger seat.
Reyes was booked into county jail on suspicion of three counts of murder, one count of attempted murder, a count of shooting into an inhabited vehicle and gang allegations, Fahey said. He is being held on $5 million bail, she said.
