Ayala charged with giving false police report

MILPITAS, Calif.

Police say Anna Ayala has done it again -- made up a story. The first story was about a severed finger. Now, prosecutors say, it's about an injured ankle.

Ayala is at the Elmwood Correctional Facility for Women in Milpitas. She was arrested Thursday after trying to help her son stay out of trouble. Ayala is charged with being an accessory to a felony and filing a false police report.

Ayala is no stranger to police or to public scrutiny. You may recall, back in 2005, she pretended to find a severed human finger in her chili, while eating at a Wendy's fast food restaurant in San Jose. It turns out she and her husband planted the finger in the food. Ayala spent four years in prison for the scam and was released in 2009.

As for her latest problems with the law, they started after her 26-year-old son accidentally shot himself in the foot outside their family home in San Jose. According to the San Jose Mercury News, he has a prior conviction for burglary and isn't allowed to have guns.

However, instead of telling police he shot himself, detectives say he and Ayala came up with an elaborate story. At first, they gave very detailed descriptions, including the names of the men who shot the son for no apparent reason.

Then they said the son was chasing after a dog when he shot himself. Police knew something was wrong and confronted the two. That's when they admitted to making the whole thing up to avoid getting in trouble for having a gun. But then Ayala confessed that she got rid of the gun which equates to evidence tampering.

Ayala is being held on $150,000 bail and she is due in court on Friday.
