Woman turns to 7 On Your Side after newly repaired rain gutter fails to collect rain from downpour.

CUPERTINO, Calif. (KGO) -- A Cupertino woman had a new rain gutter installed in her home, but it didn't seem to hold the rain, so she called 7 On Your Side for help.

Nancy Maloney walks into her backyard and points to her newly repaired rain gutters. The gutters proved to be no match for the rains during last season's winter drought.

"Water was coming down everywhere. Every single part of both sides of the house, just pouring down as if you have nothing," Maloney said.

She took pictures showing the rain water overflowing down the sides of the gutter. The pictures also show water leaking from the elbow of the rain spout. She was concerned about that when the gutter was originally installed two years ago.

"There was a gap between the pieces that's not supposed to be that way," said Nancy Maloney, a Cupertino resident.

Maloney threatened to withhold payment until she got a second opinion, but says the company Alex Gutter demanded immediate payment.

"He in said fact I will get that money no matter what," Maloney said.

When the gutters began leaking, Maloney says she was too intimidated to call her installer. Instead, she called 7 On Your Side.

Alex Gutierrez, Junior said if she felt intimidated by his father and owner, there are several other people in the office she could have talked to instead. He said she wouldn't have had this issue if she had cleaned her gutters. Gutierrez said the weight of the debris forced the elbow to come off.

"It gets heavy over time," he said. "That's why the elbow of the downspout came loose."

The company repaired her gutter for free and extended the warranty another 14 months.

The Better Business Bureau gave Alex Gutter an "A" rating.
