Attorney: Jahi McMath should be declared alive again

OAKLAND, Calif. (KGO) -- The attorney for the family of an Oakland teen declared brain dead has filed papers asking for her to be declared alive again.

Attorney Christopher Dolan filed papers in Alameda County Tuesday.

He says he has experts and tests which show Jahi McMath is not brain dead.

The 13-year-old was declared brain dead last December after a sleep apnea surgery at UCSF Benioff Children's Hospital Oakland.

The family insisted the girl was still alive and had her moved to a private facility.

If a court approves the request, the hospital or taxpayers could be on the hook for her medical costs.
