Family of man killed in officer-involved shooting to file lawsuit
An attorney for the family of a man who was allegedly shot and killed by a Richmond police officer is questioning the use of lethal force and says the family plans to file a lawsuit against police.

RICHMOND, Calif. (KGO) -- An attorney for the family of a man who was allegedly shot and killed by a Richmond police officer is questioning the use of lethal force.

John Burris says Officer Wally Jensen could have used non-lethal force against Richard Perez last Saturday, but didn't have a Taser, baton or pepper spray on his belt.

Richmond police say Perez was acting hostile outside Uncle Sam's Liquors when Jensen intervened.

Jensen claims Perez attacked him and he had to shoot.

But Burris says Jensen was not equipped to handle the incident. "A confidential inside source, that the officer was required to have his baton and his Taser with him and he had neither. It's not a state requirement of course not, but departments have policies and they have these policies and they have these practices for a particular reason," he said.

Perez's family plans to file a lawsuit against police.
