According to police, a group of fourth graders plotted to use hand sanitizer in an attach on their teacher

BUFFALO, NY -- Fourth graders in New York are accused of plotting to harm their teacher, reportedly to get back at her for yelling at them, according to WKBW in Buffalo.

The children -- all 9 and 10-year-old girls -- are students at Elba Central School in Genessee County. According to police, they knew their teacher was highly allergic to hand sanitizer, so they planned to cover places the teacher normally touches with it, hoping to harm or even kill her.

Even so, police say the kids won't face any consequences.

"Because nothing had happened, with the juvenile laws the way they are in the state of New York, for a person under the age of 16 to be charged with anything and that will be through family court, they have to commit either a misdemeanor or a felony," said Chief Deputy Jerome Brewster with the Genesee County Sheriff's Office.

The district worked with parents and the students involved to address the issue. They won't say if the girls have been suspended, only that the district will seek appropriate action.
