San Jose decides not to fine people for illegal fireworks
An outcry from San Jose residents prompted the city manager to send out warnings instead of citations for illegal fireworks and to reevaluate the ordinance.

SAN JOSE, Calif. (KGO) -- Residents who say they didn't set up fireworks were cited and they got attorney involved, and showed up to city council meeting this week well city finally listened and realized they were not being fair. The whole process will be evaluated.

Amy Guzules is breathing a sigh of relief since she found out that she won't have to pay a $500 fine for setting off illegal fireworks. Guzules says she never did it and was furious one of her neighbors pointed the finger at her.

City records show no video or photo evidence was submitted for Guzules' address. She was one of 45 people who were cited by the city of San Jose during their enforcement period in June and early July.

Residents used an online reporting system and 1,075 complaints came in for illegal fireworks. The majority were dismissed based on lack of evidence, but those who did receive citation called the process unfair.

Some spoke at the city council meeting earlier this week to complain. Guzules had an attorney contact the city attorney to express their concerns. In the end, the city manager's office decided to just issue warning letters instead of citations.

The city plans on reevaluating the process to see how to make things fair for residents but still enforce illegal fireworks.
