Woman shot by off-duty cop, sues

A woman who was shot by an off-duty San Diego police officer after a traffic dispute has filed a claim against the city seeking unspecified damages.

Rachel Silva told KFMB-TV after filing the claim Wednesday that she felt Officer Frank White used deadly force against her and her 8-year-old son when he fired five rounds during the confrontation in a parking lot.

Silva was struck twice in the arm and her son, Johnny, was hit once in the leg.

Silva, a 27-year-old, says her arm is shattered. She claims the episode resulted in emotional distress and blames the city for a failure to properly supervise off-duty conduct by its officers.

She is also requesting that the city begin psychiatric screening for its officers.
