51-year-old Michael Gressett had been on paid administrative leave since his arrest in September of 2008. He is accused of raping a 30-year-old female colleague at his Martinez home in May of 2008.
Prosecutors say the woman had initially consented but changed her mind.
Gressett claims the sex was consensual and says the case against him has been unfairly investigated by his political rivals.
