The ban was imposed after a fierce gun battle in North Hollywood in 1997 between police and two heavily-armed bank robbers.
Brown says allowing violent felons to own military-grade body armor puts public safety at risk and jeopardizes the lives of police officers.
He will file the appeal in January 2010.
