A California court has approved a deal for Gizmodo and its reporter Jason Chen to hand over their documents.
In exchange, prosecutors will return a computer and other items seized in an April search of Chen's home.
Police are still investigating whether any theft occurred of the iPhone prototype.
Gizmodo says it received the iPhone from an anonymous source after an Apple employees accidently left it at a Redwood City bar.
