Man arrested for assault after soda argument

SAN RAFAEL, Calif.

Three people who did not want to pay for soda got into an argument with a security guard at the Mi Pueblo Supermarket at 330 Bellam Blvd. around 8:45 p.m., San Rafael police Lt. Dan Fink said.

One of the three people pulled out what is believed to be a semi-automatic handgun and told the guard he was going "to put a bullet in him."

The guard backed away from the three people, who then fled the market.

Police detectives viewed surveillance video in the market and identified 18-year-old Walfre Jose Rios, of San Rafael, as the person who threatened the guard.

Police searched for Rios, a documented Sureno gang member, and found him around 1 a.m. today in the 400 block of Bahia Way in San Rafael.

Rios was arrested without incident and was booked into the Marin County Jail for assault with a deadly weapon, criminal threats, attempted robbery, and being a gang member in possession of a concealed weapon.

Rios is being held on $75,000 bail and a U.S. Immigration and Customs Enforcement hold.
