Scott Marasigan appeared in an Alameda County court Tuesday, asking to extend the restraining order against Giselle Esteban so that it includes their daughter.
Police have searched Esteban's apartment twice and questioned her over the disappearance of Michelle Lealmost three weeks ago.
Esteban did not did not appear in court.
Marasigan has custody of their child and says he is concerned for her safety.
