Orlando Nembhard, who has been jailed since March, was charged in connection with a deadly shooting outside a Chandler nightclub.
Now, it's likely Nembhard will be released on bail because some witnesses at the crime scene say it was his twin brother, Brandon, who is the real killer.
Police don't have the murder weapon, and there's very little forensic evidence.
"Having a twin brother that was at the incident, or at the location of the incident, probably complicated things as well," said Seth Tyler with the Chandler Police Department.
Yesterday, a judge ordered bail for Nembhard to be lowered.
Nembhard has faced prior charges of burglary and marijuana possession. His twin brother does not have a criminal record.
