An Antioch family of an 8-year-old boy has filed a claim accusing his third grade teacher of duct-taping his mouth shut and another teacher of placing a chair over him and sitting on it.

The boy, who has learning disabilities, attends Antioch Charter Academy II on West 10th Street. The San Jose Mercury News reports another student also had his hands duct-taped.

The suit seeks $10,000 in damages and claims four school employees witnessed the incidents last November and failed to notify authorities as required. The principal conducted an internal investigation and found no wrong-doing. The principal is the mother of one of the teachers named in the suit.
