Drakes Bay Oyster Farm can stay open during appeal

SAN FRANCISCO

The Ninth Circuit Court of Appeals blocked a government order evicting the Marin County farm from Point Reyes.

The ruling means Drakes Bay can keep operating while it appeals the case to the U.S. Supreme Court.

The government wants to turn the estuary into a marine wilderness area. It decided not to renew the oyster farm's lease last year.

Drakes Bay has been operating in Point Reyes for nearly a century.
