SAN RAFAEL, Calif. (KGO) -- A Marin County doctor who was exonerated earlier this month of shooting a man after a road rage incident has been indicted on new charges.

The I-Team has learned Doctor James Simon will appear in Marin County Superior Court Friday to answer to a grand jury indictment accusing him of negligence and assault.

Simon shot Bill Osenton after the retired mortgage broker followed the doctor home and into his garage in Corte Madera last summer. In the preliminary hearing, the judge ruled Dr. Simon had a right to defend himself in his own home, and dismissed a criminal case against him.
