Family confronts suspect in alleged DUI crash in Livermore that killed mom, baby

LIVERMORE, Calif. (KGO) -- Outside a Pleasanton court on Tuesday, family and friends who lost a mother and toddler in a suspected drunk driving accident chased down the man accused in the deadly accident.

Livermore resident Brian Jones is accused of hitting and killing 46-year-old Esperanza Morales of Seaside and her 14-month-old daughter Juli on Saturday.

It was an emotionally charged court appearance for the 35-year-old suspect. He didn't say a word, but friends and family of the dead mother and daughter sure did.

"You are a murderer, a killer, you don't deserve to be breathing. How does it feel to kill two innocent people?" asked one person.

After the court hearing, supporters of the two victims trailed Jones, his family, and his attorney to a waiting vehicle.

Alameda County prosecutors said Tuesday they aren't yet filing charges against Jones. However, prosecutors say they're still reviewing the potential case and could still file charges against him at a later date.

Jones, who was arrested on suspicion of gross vehicular manslaughter and DUI, had tentatively been scheduled to be arraigned in Alameda County Superior Court in Pleasanton at 9 a.m. But his potential arraignment was postponed until May 28.

"The judge in there says they need more time to find out (the) charges," said Delila Hall, a friend of the victim. "What kind of more proof (do) they need? They need more bodies to be in there?"

Due to the lack of further charges or court action, and since Jones posted a $350,000 bond earlier this weekend, he was able to walk out of court on Tuesday morning.

Attorney Ernie Castillo tried to speak on his client's behalf.

"Mr. Jones is truly remorseful for what happened," said Castillo. "He's been an emotional wreck every second of the day over what happened."

"The fact that he was out, the judge doesn't do nothing, not even a slap on the hand, that's not right. That's what made me angry," said the victim's friend Dalila Hall.

Jones is accused of losing control of his Corvette while driving under the influence of alcohol and crashing into an apartment complex in the 900 block of Murrieta Boulevard just before 6:50 p.m. Saturday.

Police say the child and mother, who were walking on a paved path between the sidewalk and the apartment complex, were crushed before Jones' car smashed into the party that both victims were walking to.

Two children at the party were also injured, but have since been released from the hospital.

Police say the suspect attended the Livermore Wine Country Festival before the crash, which is about a half mile away. According to authorities, Jones had a 0.14 percent blood content, which is more than the legal limit.

The victim's family tells ABC7 News that they plan on having more people here for the suspect's next hearing on May 28.
