SAN JOSE, Calif. (KGO) -- Former San Francisco 49er defensive lineman Ray McDonald is suing the woman accusing him of rape. His attorney says McDonald hasn't been able to get another job in the NFL because of the allegations she made. So now, he's trying to clear his name through legal action.
McDonald insists he's no rapist and now he's fighting back. In his complaint, McDonald says his accuser defamed him and hurt his career. He's since been fired from the 49ers and hasn't been able to get another job.
McDonald's attorney, Steve DeFilippis, told ABC7 News, "Teams are sitting back waiting to see what's going to happen in this before they make a decision. It's basically changed his marketability in the NFL."
McDonald claims he and his accuser met at the Willow Den bar in San Jose Dec. 13. He was with two other 49ers that night and according to the bar owner, it was a low-key evening.
"I wasn't tracking their drinking, but I would say they weren't even drinking that much," bar owner Hans Heller said.
But the big question is what happened when they ended up at McDonald's house. She claims she was raped after she fell and hit her head near the pool, waking up naked in his bed with no memory of what happened. But McDonald claims video captured by his security cameras prove otherwise.
In his complaint, his attorney says she even "...went to the store with Plaintiff to get more alcoholic beverages, and over the course of that day, had consensual sexual relations with Plaintiff McDonald several times, while fully cognizant of what was occurring."
ABC7 News tried reaching out to McDonald's accuser, but a family member said they had no comment.
As for the 49ers response, the team simply said, "He doesn't play for us anymore."
