FREMONT, Calif. (KGO) -- A fundraiser is planned for the family of a U.S. Marine who was killed by an alleged drunk driver in Fremont.

Fremont police officer Alan Zambonin wrote in an affidavit that 23-year-old Alexander Yohn of Emeryville had refused offers of a ride after a night of drinking before causing the crash that killed 23-year-old Andrew Silva of Union City who was riding his motorcycle.

Silva was a Marine lance corporal with a wife and 2-year-old son who had returned from Afghanistan in February.

Alameda County prosecutors charged Yohn with murder, vehicular manslaughter with gross negligence and hit-and-run. He is being held without bail.

Court records show that Yohn was convicted in Minnesota for drunk driving and that he admitted to investigators that he's a heroin addict.

Mountain Mike's Pizza on Washington Boulevard in Fremont is holding a fundraiser for Silva's family. It began Friday morning and runs through Sunday at 9 p.m.

The owner says he will donate 20 percent of the proceeds to for the family's expenses.

Fremont Bank has established the Andrew Silva Memorial Fund. They're hoping that money raised can help Silva's widow establish a college fund for their son. Public services for Silva will be held next week.

Fremont Bank has established an account for Silva's wife and young child. Donations can be made at any Fremont Bank branch or by mail to Fremont Bank, Attn: Andrew Silva Memorial Account, P.O. Box #8170, Fremont, CA 94537-8170.

Checks should be made payable to "Andrew Silva Memorial."
