Officials say a a woman called to report that her boyfriend, Omenihu, pushed her to the ground during an argument. She complained about pain to her arm, police say, but there were no visible injuries and she declined medical treatment at the time of the investigation.

Officers contacted Omenihu at the scene. He gave a statement and was cooperative with officers.

He was then arrested for misdemeanor domestic violence and he was served with a restraining order by investigating officers. It was not deemed a felony arrest.

"There's many different factors," San Jose Police Dept. Sgt. Christian Camarillo explained. "Some of them include, what the relationship is, do they live together, do they have children together. What classified this as a misdemeanor and not a felony was that there was not any visible injury, there was the mere complaint of pain."

Omenihu was booked into the Santa Clara County Main Jail for misdemeanor domestic violence, but has since posted bail and is no longer in custody.

The case will be submitted to the Santa Clara County District Attorney's Office for possible charges.

The 2019 fifth-round pick, Omenihu has been part of the defensive line rotation for the Niners during their playoff run, recording a sack in the win against the Seattle Seahawks in the Wild Card round.

ABC7 News has reached out to the 49ers on the arrest of Omenihu. They said: ""We are aware of the matter involving Charles Omenihu and are in the process of gathering further information."

We also reached out to Omenihu's business and marketing contact Rey Soto Tuesday morning.

He told us via an Instagram message that he intends to clear the air and get the story straight, but we have not heard back after that.

"This investigation just started yesterday," Sgt. Camarillo said. "It's going to go over to our Family Violence Unit where detectives and investigators there will continue the case. That case will be presented to the Santa Clara County DA and they will make the deciding decison on whether or not charges will be filed against Mr. Omenihu."

We have been in contact with the Santa Clara County District Attorney's office who tells us no charges are expected to come down Tuesday.
