Hayes was the boyfriend of Dominick's mother, and is charged in the little boy's death.

"At least on one occasion my client was totally unaware of why he was in jail, did not understand he was in jail for murder as well as did not know that the victim in this case had died," James Piazza said, "and with that, he is unable to assist me in trying to prepare for preliminary examination in this case."
On top of that, Piazza said his client was recently treated at an Ypsilanti hospital for mental illness. When he was in the Livingston County Jail in March, a social worker there apparently petitioned probate court to have him treated.
Piazza told the judge that a doctor diagnosed his client as a paranoid schizophrenic and as being mentally ill. "He went to Saint Joseph, and after a week or so there, too, he was released. Somebody from probate court should have followed up in Livingston County and they didn't. I'm still trying to investigate what happened."
The prosecutor in court today said his office has been in touch with the forensic center and the hope is that this evaluation will be expedited.
A hearing on the findings is tentatively set for June 8.
Dominick's mother, Corrine Baker, who is also charged in his death, may ask for this same type of evaluation, according to the prosecutor.
She's back in court next week.
