Damian White Jr., 17, has a tracheotmomy. He says he has difficulty breathing because of a condition called "angiofibroma."
He also says a substitute teacher aggravated that condition by putting him in a sleeper hold.
It allegedly happened at Start high school the morning of Tuesday, November 2. According to the police report, Andrew Delffs, 33, was a substitute gym teacher that day.
When White showed up late, Delffs asked if he had a late slip. The student said no and the teacher told him to leave.
Toledo police say there was a verbal confrontation, then another "with noses touching."
The teacher told police White "reached into his pocket," adding "I didn't know if he had a weapon or not."
That's when Delffs used his arm to grab White by the neck and take him to the ground.
The report also states a video recorded part of the incident and that after reviewing it, police would not file charges against either person.
Toledo public schools, however, removed White from Start, with the intent to expel. According to a notice of removal from TPS, Damian White Jr. used profanity and verbally threatened a teacher, which is in violation of the student code.
