An attorney for Stuart Forrest, 61, says law enforcement agents can be in possession of child porn as part of their official duties.
Forrest has been charged with two counts of possessing sexually-explicit photographs of minors.
He remains out of jail on $100,000 bail and he's due back in court July 9.
