Former 49ers DE Ray McDonald posts bail; DA considers filing charges
Former San Francisco 49er Ray McDonald is facing another new charge after being arrested again on Wednesday, just two days after a domestic violence arrest.

SANTA CLARA, Calif. (KGO) -- Former San Francisco 49er Ray McDonald is facing a new charge after being arrested again on Wednesday, just two days after a domestic violence arrest.

This latest case is now in the hands of the Santa Clare County District Attorney's office. Prosecutors will decide if charges will be filed against McDonald.

McDonald posted bail Wednesday night and walked out of Santa Clara County Jail at around 11 p.m.

Detectives say they learned McDonald violated a restraining order for being at a home in Santa Clara related to his domestic violence and child endangerment arrest on Monday that involving his former fiance and their infant.

Santa Clara police arrested him at a Togo's restaurant on Tasman Drive across from Levi's Stadium.

A Togo's employee says McDonald came back in and asked for their address and then she saw the officers pull up.

"He looked distraught, a little off. He came in sat over there 3-4 minutes was in and out on phone," explained Shirin Dashtis, a Togo's employee.

McDonald's attorney told ESPN that he was never served with a restraining order, and although he was told to stay away from his former fiance, he said McDonald went to the home to meet with a defense investigator and was told she would not be home.

The 49ers released the defensive end in December citing a "pattern of poor decision making."

McDonald has been arrested four times since last august, but Santa Clara County prosecutors have not filed any charges related to those cases.

McDonald filed a defamation lawsuit in March against a woman who accused him of rape back in December.

McDonald signed with the Chicago Bears in the NFL offseason, but they released him just hours after Monday's arrest.
