44-year-old Terry Childs is being held on $5 million bail. He was arrested last summer after refusing to provide passwords to the city system after he was told he would be reassigned.
Childs finally gave the passwords to Mayor Newsom eight days after his arrest. Last Friday, the judge threw out all but one charge against Childs.
The district attorney plans to appeal that ruling Monday.
