The State Senate confirmed Maldonado last week, but the assembly could not reach a majority vote to either confirm or deny Maldonado's appointment.
Governor Schwarzenegger initially threatened to swear-in Maldonado, but, assembly Democrats objected and said they would take the case to court.
Lawmakers will now get another 90 days to decide on how to vote on the governor's nomination.
