Toledo police get mandatory retirement notices

TOLEDO, OH 13abc obtained copies of mandatory retirement notices sent to two officers.

Toledo police adminstrators sent a letter regarding mandatory retirement to a lieutenant and a sergeant. The letter reminds the officers of a clause in the Toledo Police Command Officers' contract.

It states: "An employee upon attaining the age of 65 years shall be retired by the city and his employment terminated as of the last of the month in which the employee has attained the age of 65."

The memo states the officers can continue employment until the end of the year if they sign a memorandum of understanding by today. If they don't sign the document, their last day will be July 2.

Union leaders claim they have no grounds to fight the city's notification.

This move is different from city policies and procedures in the past. The city has allowed former officers Jim Ogle, Richard Murphy, Robert Baumgartner and Bob Brannon all to work past age of 65.

Today we learned both Lieutenant William Moton and Sergeant Karen Martsen decided to fight early retirement. The city of Toledo has 30 days to decide what the police department should do about Moton and Martsen's employment.
