Police say 60-year-old Richard Poccia pulled a knife on officers before one of them tased him and another shot Poccia with a rifle.
Napa police say they followed proper procedure, but now the Poccia family's attorney says there was no mention of a knife until several days after the shooting. Poccia's daughter says her father, who was a nurse, was not violent.
"He was dedicated to helping people who were sick and in the end when he needed help, the authorities did not give help and he ended up dead," says Poccia's daughter Gabrielle.
Investigators say Poccia's family called police saying he was depressed and had firearms in the house.
