SAN JOSE, Calif. (KGO) -- Recreational marijuana could soon be legally sold in San Jose.



On Tuesday, the city council will vote on whether to allow the sale and delivery of marijuana to anyone over the age of 21-starting January 1st.



California voters approved the legalization of recreational marijuana last November with Prop 64. But, the San Jose City Council passed a ban on recreational pot.



Now, the council is ready to revisit the issue.



Councilmembers are considering allowing the city's 16 currently operating medical marijuana dispensaries to also sell, and deliver recreational marijuana.



Councilman Johnny Khamis said he supports the change because it will allow the city to tax and regulate sales. He said that will help keep pot out of the hands of minors.



The owner of Buddy's Cannabis said he expects business to increase by 30-percent.



He's already upping production and has added an extra cash register in his store.



But, he says getting permission from the city is only the first step. He and the other dispensary owners would still need to apply for and receive a state license.
