SAN FRANCISCO (KGO) -- A judge threw out charges Tuesday against a senior citizen after he was cited by a San Francisco police officer for eating pizza at a bus stop.

ABC7 News was at the San Francisco Hall of Justice when supporters of Daniel McHugh shared pizza.

McHugh faced a $234 fine after an officer gave him a citation, in March. McHugh happened to be homeless at the time.

That officer did not show up in court Tuesday afternoon. "I have total respect for the law and the police department, yet he didn't even show up. So, I don't know what I can say. Other than it was dismissed and I am very grateful," McHugh said.

Eating is banned on most public transit in San Francisco, but police rarely enforce the law.
