Old Navy facing lawsuit after 11-year-old girl is videotaped undressing in Hanford

HANFORD, Calif. -- A young girl who was reportedly the victim of a sex crime at an Old Navy is now undressing the popular clothing store, exposing practices that she says led to the incident.

Police say an employee videotaped the girl changing in the dressing room at the Hanford Old Navy. Even worse, she was far from the first victim and this lawsuit claims Old Navy let it happen.

Bargain shopping brought a Hanford family to Old Navy. A disturbing invasion of privacy brought them to police. Their 11-year-old daughter noticed something fishy in the dressing room and investigators discovered an employee had caught her changing on camera.

"They're horrified and they're working through it, but the police department has been great and were thankful she came forward to stop it or this would've continued," said the victim's attorney Warren Paboojian.

And as Paboojian said, the 11-year-old wasn't the only customer caught on camera. Hanford police say Jesse Gratton's phone had video of several customers in the dressing room.

"We don't know because we don't know how many have been downloaded and the problem is that the faces of the individuals are not on the videos. You know, mostly it's just body parts," Paboojian said.

He filed the family's lawsuit against Old Navy, accusing the store of missing red flags and warnings about what Gratton was up to. Police say the videos they've seen go back for weeks, but Gratton was on the job for about six months. ABC30 legal analyst Tony Capozzi says the longer it was going on, the more trouble for the retailer.

"Old Navy may not have been aware of the others, but in their supervision of their employees, this should've come to their attention," he said.

ABC30 reached out to Old Navy for comment and they called us back after this story aired, but their representative said the company couldn't comment on a pending lawsuit.

Police say they know there were at least seven more victims. They're hoping parents will come forward
