Two property owners near the tracks in Menlo Park filed the suit. They wanted construction of the high speed rail line between San Francisco and San Jose delayed until Union Pacific signs off on the project.
Union Pacific runs late night freight trains along that corridor. Union Pacific officials have said they will not try to block the high-speed rail.
