A U.S. district judge rejected a request by the defendants to throw out the lawsuit. The judge cited Apple co-founder Steve Jobs who is quoted as saying, "Agreements between publishers and Apple would cause consumers to pay a little more."
Jobs also said prices would be the same at Apple and Amazon.com.
There was no comment on the day's ruling from Apple.
