His mother was killed at the scene and her boyfriend was critically injured. Police say his blood alcohol level was more than twice the legal limit when he crashed into a tree on California Street and Allston Way.
The boy, Xavier Chevez, died Friday night at Children's Hospital Oakland. His mother was on track to graduate from UC Berkeley in August with degree in social welfare.
