Woman alleges rape by San Jose police officer after DUI arrest

SAN JOSE (KGO) -- The woman who claims she was raped by an off-duty San Jose police officer reported the incident only after she was arrested three weeks later by the CHP on drunk driving charges.

Officer Geoffrey Graves, 38, of Gilroy did not enter a plea to the rape charge when he appeared in court last month. He is currently free on bail and due to return to court this month.

The San Jose Mercury News reports prosecutors don't dispute the alleged victim's DUI arrest may have spurred her to report the sexual assault. But they point out the case against officer Graves is supported by DNA and other evidence.
