The county's Open Space Authority approved the property assessment in 2001.
But the California Supreme Court Monday said that the assessment violates state law. That law limits governments' ability to raise revenue without voter approval.
The head of the Open Space Authority said it could take one year for the courts to figure out what should be done with the $65 million that has already been raised.
