Sacramento baby taken by CPS returned to parents

PALO ALTO, Calif.

Sammy Nikolayev is 5-months-old and suffers from a heart condition. He was placed in protective custody last week after his mother removed him from Sutter Memorial in Sacramento against doctor's orders.

His mother says she removed her son from the hospital because she was unhappy with the care. "They told us we need to do surgery right away and we want to have a second opinion from a second doctor from a different hospital, and I took my son," Anna Nikolayev said.

A doctor at Kaiser Permanente said it was safe for Sammy to go home, but CPS showed up the next day and removed Sammy. A judge has since returned custody to the parents.

Sammy is expected to go home with mom and dad after he undergoes an evaluation at Lucile Packard Children's Hospital at Stanford.
