The airline has denied discriminating against Iftikhar Nazir because of his Pakistani ethnicity and his Muslim religion. United says it fired him in 2005 for using force against a janitor.
But, the Court of Appeals says there is evidence that was just a pretext to fire him and the court says he can take his case to Superior Court in San Mateo County.
Nazir says he complained repeatedly about name calling and harassment over the years, and he says supervisors did nothing.
