Pizza restaurant vandalizing by competing restaurant

The manager and a former employee of Extreme Pizza were arrested this morning on suspicion of spray-painting the nearby Pizza Orgasmica & Brewing Co. in San Rafael, police said.

Timothy Tucker, 32, manager of Extreme Pizza at 703 Fourth St., and Sean Clymer, 26, were booked into Marin County Jail for felony vandalism. Clymer also was booked on a misdemeanor charge of being drunk in public.

Their bail is $10,000 and they are scheduled to appear in Marin County Superior Court at 1:30 p.m. today.

San Rafael police spokeswoman Margo Rohrbacher said Stephanie Loftis, the manager of Pizza Orgasmica & Brewing Co. at 812 Fourth St., was inside the restaurant around 3 a.m. when she saw a man spray-painting the front of the restaurant, which is painted in the bright yellow and green colors of the Brazilian soccer team's jerseys.

Police arrived within a minute and found two suspects at the corner of Fourth and Cijos streets, Rohrbacher said.

The two men were trying to discard at least two black spray paint cans and latex gloves in a Dumpster as officers drove up, Rohrbacher said. Loftis identified Tucker as the man she saw spray-painting the front window of the restaurant, Rohrbacher said.

The damage to the restaurant is estimated at $7,000, Rohrbacher said.

Taylor Maia, owner of Pizza Orgasmica, said the vandals painted the words "go home" and dollar signs on the front and back of the restaurant.

Maia said he received a text from Loftis about the vandalism at 3:18 a.m.

"It's a pity. This is a beautiful place and location. Nothing is going to stop us," Maia said this morning.

The San Rafael Design Review Board determined the new Pizza Orgasmica's colors were too bright and asked Maia to tone down the colors last month.

Maia said the restaurant's colors will remain green and yellow but will be leas bright.

San Rafael senior planner Kraig Tambornini said he met with Maia last Friday. Maia agreed to add a softer yellow color to the large walls of the restaurant but plans to retain the bright yellow and green color scheme on the front entryway, Tambornini said.

"We're on a path to getting something done," Tambornini said.

There will be no further meetings or public hearings on the issue before the Design Review Board, Tambornini said.

"We'll let the board know a solution has been reached and refer it to the board for its consent," he said.
