Tourist gets probation in jet ski crash that killed teen

VACAVILLE

Tyler Dagley, 20, was vacationing on Oahu when he crashed his rented jet ski into 16-year-old Kristen Fonesca's watercraft from behind on August 5. Investigators say he was looking at his girlfriend, who was taking video and photos, and he wasn't paying attention to where he was going. Fonseca died the next day.

On Wednesday a judge sentenced Dagley to credit for the 12 days he served in jail and a chance to wipe the case from his record in a year if he meets conditions of probation. He must also serve a day of community service each month and pay $78,138.06 in restitution for Fonseca's medical and funeral expenses.

Before the sentence was handed out, the court heard from Evangelina Canton, Kristen's mom, "I go into her room every so often to lay on her bed and smell her pillows, hold one hankie and pretend it's her."

Fonseca's family is suing Dagley and the jet skiing company.
