Plea deal considered for alleged gang leader

U.S. District Judge William Alsup granted a defense motion for a mistrial in the death penalty case of alleged San Francsico gang leader Emile Fort and is now considering a plea bargin that would send Fort to prison for 40 years.

Fort, 27, was on trial for racketeering charges, including three murders and two attempted murders in 2003 and 2004.

The mistrial and consideration of the plea deal may signal a shift in policy for death penalty cases under new Attorney General Eric Holder.

Sentencing will be held May 20, 2009.
