Phillip Michael Dominguez and his girlfriend, Racquel Martinez, are being held at the Santa Clara County Jail.
Authorities believe Dominguez took the little girl Tuesday while she was playing in front of her home on Balfour Drive. They say he took her to his nearby home, sexually assaulted her, and then released her.
Martinez is accused of aiding in the crime.
