Officers arrested James Francis Lee of San Jose on vehicular manslaughter and felony DUI charges Sunday night.
Investigators say the boy died after his family's pickup was rear-ended by Lee's truck.
The crash closed the southbound lanes of Highway 101 near Bailey Road for about an hour Sunday night.
The coroner identified the victim as Jose Cortez-Diaz of Gilroy.
Both of his parents escaped serious injuries.
